Fair Usage Policy

Note: If the Terms, Policy, or Agreement are available in multiple languages and any discrepancies exist between translations, the English version shall prevail.

A. Introduction​

BabySea is committed to providing high-quality AI services to all our users. This Fair Usage Policy ("Policy") is designed to ensure equitable access to our resources and maintain service quality for our entire user community. By using BabySea services, you agree to comply with this Policy.

B. Purpose​

This Policy aims to:

  • Ensure all users receive consistent, high-quality service.
  • Prevent excessive use by a minority of users that may impact the experience of others.
  • Maintain the stability and availability of our infrastructure.
  • Allocate resources fairly among our user base.

C. Scope​

This Policy applies to all BabySea services. It covers both free and paid tiers of service, though with different thresholds as specified below.

D. Usage Limits​

1. General Guidelines​

We monitor several metrics to ensure fair usage, including but not limited to:

  • Number of API calls or requests per time period.
  • Processing time consumed.
  • Storage space utilized.
  • Computational resources required.
  • Bandwidth consumed.

2. Specific Limitations​

Each BabySea platform maintains its own specific limitations and capabilities for free and paid plans. Please consult the documentation for each individual platform to understand the exact features and limitations that apply to your subscription.

E. Monitoring and Enforcement​

1. Usage Monitoring​

We continuously monitor usage patterns across our platform to ensure compliance with this Policy. Our systems automatically track usage metrics and may issue notifications when you approach your allocated limits.

2. Notifications​

You will receive notifications through our platform or via email when your usage reaches certain thresholds:

  • 75% of your limit.
  • 90% of your limit.
  • 100% of your limit (at which point restrictions may apply)

3. Enforcement Actions​

If you exceed the defined usage limits, we may take the following actions:

  1. Throttling. Temporarily reducing your access speed or processing priority.
  2. Suspension. Temporarily suspending certain features or services.
  3. Limit Extension. Offering the option to upgrade your plan or purchase additional capacity.
  4. Account Review. Reviewing your account for potential misuse or Terms of Use violations.

Enforcement actions will be proportionate to the level and frequency of excessive usage.

F. Prohibited Activities​

The following activities are explicitly prohibited under this Policy:

  1. Automated Scraping. Using automated tools to extract large amounts of data from our services without prior authorization.
  2. API Abuse. Making excessive API calls or trying to circumvent rate limits.
  3. Resource Hoarding. Consuming disproportionate resources through inefficient requests.
  4. Reselling Access. Sharing your account or reselling access to our services.
  5. Denial of Service. Any activity that could impair service availability for other users.

Any prohibited activity may result in immediate suspension or termination of your account, as outlined in our Content and Use Policy.

G. Exceptions​

We understand that certain use cases may legitimately require higher usage limits. If you anticipate exceeding the standard limits, please contact us at dev@babysea.ai before reaching your limits to discuss your needs.

Enterprise customers should refer to their custom Service Level Terms for specific exceptions or arrangements.

H. Changes to This Policy​

We may update this Fair Usage Policy from time to time. We will notify you of any changes by posting the new Policy on this page and updating the "Last updated" date. You are advised to review this Policy periodically for any changes.
